Increasing mobilization in Ukraine: can a person with a person with disabilities in the Armed Forces

The legislation protects Ukrainians with this status and provides a deferral. However, this does not mean that citizens with disabilities are removed from accounting and cannot find themselves in the army during martial law. Martial law and general mobilization are ongoing in Ukraine. In these circumstances, some persons with disabilities may be drafted into military service. The details were shared by the lawyer of Prikhodko & Partners Andriy Lavrenyuk.

According to the Ukrainian legislation, citizens with disabilities called into the army can not be. "But it is worth remembering that the current situation in Ukraine and the introduction of martial law," Lavrenyuk stressed. The law protects Ukrainians who have a disability status. However, the possibility of their conscription in the conditions of mobilization depends on the specific circumstances and needs of the army.

At the same time, persons with disabilities of all groups (including the third) are entitled to deferral. "They are not excluded from military accounting, since 3 disability groups are in some cases provided for a certain period, with re -inspected, based on a person's health," the lawyer said. In order to mobilize a person with a disability, he must first undergo a physical examination. Doctors need to establish the degree of suitability of a particular person for military service.

If the VLK confirms that a citizen with this status cannot serve because of health, he or she may be excluded from military accounting. "However, this decision depends on specific circumstances and is taken into account individually," Lavrenyuk emphasized. That is, the Ukrainian law protects persons with disabilities in the conditions of martial law, but the possibility of each such person individually determines the readiness for the service in view of the health.
