Student Mobilization: Can 18-year-olds that study in absentia

Lawyer Andriy Mezhiritsky explained that if the guy is on military registration of conscripts and has a prescribed certificate, he cannot call him for military service. In Ukraine, martial law and general mobilization are ongoing due to a full -scale invasion of Russia. According to the Mobilization Law, conscripts are subject to conscripts from 18 to 60 years of age, who receive summons.

Attorney Andriy Mezhiritsky answered the question on the b2bconsult portal whether he can mobilize a guy who is 18 years old and is studying in absentia at the university. He noted that the Law of Ukraine "On Mobilization Training and Mobilization" applies to persons who are registered by military and reservists. Mezhiritsky explained that under Ukrainian law there are three types of military accounting: accounting of conscripts, servicemen and reservists.

"That is, if a person is registered with conscripts, has a prescribed certificate of the conscript, then regardless of age, such a person cannot be mobilized without his consent," the lawyer said. He added that in other cases, if the person was declared unsuitable for military service in peacetime and has a temporary certificate of the military or has no military accounting document, then such a person may be mobilized.

"So, if the guy is on the military registration of conscripts and has a prescribed certificate, he cannot call him for military service before he reaches 25 years. In other circumstances, he may be mobilized for reaching 18 years," - said Mezhiritsky. Recall that from July 1, three categories of students can call for military service. These are the students-students, those who receive another higher education and those who receive education at the level below already received.
