Five years of prison: in Ukraine for the first time during the Great War with the Russian Federation, the evasure was given the maximum term
The Obolon District Court of Kyiv found guilty of evasion of service in the Armed Forces of the State Committee of Donetsk. The case file states that in early June 2023 the accused was recognized as suitable for military service. In mid -September last year, the Tax Code handed the man a "combat" summons to the army. Not having the right to defer, the man ignored the call.
In court, he pleaded guilty and said that he had not arrived at the point of departure because he had to go to the elderly parents who needed outside care. The man stated that he understands civic duty, but he cannot and will not be served. At the interrogation, the employee of the Tax Code said that the accused was suitable for service and refused to fight, as his close relatives live in Donetsk region. This fact prevents the conscript to join the Armed Forces.
The judge decided that the residence of the father and grandmother of the accused in Donetsk region, and his wife - in the temporarily occupied territory, is not a valid reason that justifies evasion of mobilization. The court also did not take into account the sincere repentance of the conscript. According to the court, the man did nothing to correct the situation. He was constantly in the capital and did not appear in the CCC without valid reasons.
The court rejected the prosecutor's calls for imposing a sentence that is not related to imprisonment. As a result, the accused was taken into custody immediately after the sentence was made. It is held in the Kyiv Detention Center until the sentence is entry into force. We will remind, the Verkhovna Rada recently proposed a bill that expands the powers of military police. The text of the document states the permission to enter the housing of suspects in the commission of a crime.
