The state will pay: how to get compensation for property damaged as a result of war

In a war, the issue of compensation for damaged or destroyed property is of particular relevance. Loss of housing, car, business or personal belongings is not only a material blow, but also an emotional trauma. However, the state, international organizations and insurance companies provide for compensation mechanisms, reassures lawyer Sergey Litvinenko.

In the conditions of war, natural disasters or other emergencies, the issue of compensation for damaged or destroyed property is of particular relevance. Loss of housing, car, business or personal belongings is not only a material blow, but also an emotional trauma. However, the state, international organizations and insurance companies provide for compensation mechanisms. Let's look at how Ukrainians can get compensation and what documents are needed.

Pursuant to Article 2 of the Law of Ukraine "On compensation for damage and destruction of certain categories of real estate objects as a result of hostilities" defines the list of persons entitled to compensation for damaged/destroyed real estate objects.

In particular, the legislator referred to such categories: at the same time, it should be noted that the said Law also provides a list of persons who are not entitled to compensation, in particular: to receive compensation for damaged or destroyed real estate, it is necessary to apply, and it can be done by citizens of Ukraine who have reached the age of 18. A prerequisite is the availability of information on ownership in the State Register of Real Property Real Property.

The most convenient way is to apply through the action portal or mobile application. To do this, you can also do this by contacting the CNAP (administrative service center) or a notary who has access to the registers.

To do this, you need to have: compensation is accrued for housing, which: today compensation is provided for damaged residential objects for repair - purchase of construction products for the purpose of performing current or major repairs by the recipient of compensation or by ordering the relevant works and services on the real estate object.

If the injuries relate to apartments in an apartment building, compensation can only be provided if public places (stairwells, elevators, roofs, entrances, etc. ) have not been damaged or such damage were eliminated (repaired) after fighting. Compensation for destroyed residential objects is provided by issuing a housing certificate or monetary compensation for reconstruction on their own land.

It is important that you can get a cash payment if you destroy a private dwelling house and you have a land for the construction of a new house and if the land plot is in the territory controlled by Ukraine and not in the war zone. At the same time, 50% and 50% are credited to compensation for compensation. To obtain them, you must submit a message about the start of construction work through the "Action" or CNAP portal. This will be the first tranche to be used within 18 months.

In order to get the second tranche, you need to start construction work and develop a project documentation. At the same time, it is necessary to complete the construction within 36 months from the first transfer of funds. As a result, I would like to point out that compensation for damaged or destroyed property is not only a mechanism of material compensation, but also an important element of social justice and support for citizens affected by the war.

Ukrainian legislation clearly defines the categories of persons entitled to such compensation, as well as the procedure of obtaining it. Thanks to digital tools, including the action portal, the application process has become accessible and transparent. At the same time, it is important to remember that compensation is not an automatic payment, but a legally regulated process that requires proper documentary confirmation and compliance with the deadlines.
