Surbed € 100,000: a student of the lawyer was released from a restaurant as he did with the employer
Madjid did not want to stay in a new position and the employer released him without a prior notification. While the case was considered in court, the student graduated from Munich University of Ludwig-Maximilin and received a diploma on law. The employer argued that when the student was released, he took into account his part -time work. In addition, he was young in his 24 years, had no children and alimony obligations.
The Munich Court of Labor Disputes found his dismissal illegal and decided that the employer discriminated against his subordinate during his release on age. The student put forward 36 requirements for the employer, including compensation for all the damage for the period after the release and compensation of possible tip. The restaurant owner, by court decision, must compensate him with all the loss of his earnings since August 2021.
The plaintiff is obliged to pay leave for six months, since the employer did not inform the student about his or her leave. The director of the restaurant can also be held personal responsibility. The Munich Court of Labor Disputes initially granted the claim for unfair dismissal, but rejected its claims for compensation. The student presented himself in the first instance on his own and appealed this decision with the help of the Law firm Montanari.
In his profile on the social network Linkedin Madjidi wrote that for four years he spent thousands of hours on the judicial practice, legal materials, essays, comments and dissertations to support the arguments in this court case. "For four years I have struggled with these lawlessness in court, using all available legal means," he said.
According to him, such efforts bring fruits and waiters in Germany now they have the right to compensate for the tips for illegal release, bonuses for beer, to participate in the production meetings and to demand the apology of the employer in case of his incorrect behavior. "I hope this difficult result will serve as a lighthouse for others, motivating them to fight for fair and transparent working conditions," he summed up.
