100 thousand hryvnias for the transfer of cars for the Armed Forces: why in Ukraine began to fine volunteers

Ukrainian volunteers receive penalties for the "wrong" transfer of the car to military units, there are already appropriate court decisions. The focus found out why they were punished for help and what to do to avoid cash. In Ukraine, volunteers are fined for the transfer of cars that were imported from abroad in 2022-2023, not those military units specified in customs declarations.

According to People's Deputy Nina Yuzhanina, the amount of fines reaches 100 thousand hryvnias, there are already appropriate court decisions. "Among the arguments is a formal violation of customs rules. But such cars are really transferred to military units, but changes to customs declarations cannot be made by volunteers (the law does not allow)," Nina Yuzhanina said.

She noted that on December 18, she filed amendments to the Customs Code for cancellation of liability for the transfer of cars imported as humanitarian assistance, if these vehicles were transferred to any military unit, which is confirmed by the necessary documents. "The fine for volunteering is shameful," the People's Deputy said.

A lawyer, a partner of the Kravets and partners, Rostislav Kravets reported focus that volunteers would be fined for violation of the rules of importation of vehicles, because the privileges are granted for the importation of the car under a certain military unit. "Formally-this is a violation of customs rules, so these fines are applied.

I believe that it is an excessive formalism, and the state needs it already legally regulated, because in any case, this vehicle has got to the military unit, even if not to the one to which he was imported, "he explained. The lawyer stressed that privileges for the importation of cars for the Armed Forces were granted to improve defense capability and because of the state's inability to do so.

Economist Oleg Hetman noted in a conversation with focus that volunteers need to do everything in accordance with the current Ukrainian legislation. "If the legislation stipulates that cars imported without taxes should be transferred to this part, if there is a corresponding letter from this part, then they must be transferred to this part," he said. According to the economist, when the state deprives any goods of all taxes, it is impossible to do anything you like.

After all, on goods imported without taxes, you can "build". "Therefore, when such serious benefits, deprivation of all duties and taxes occur, it is necessary to act in accordance with the current legislation and to be transferred only to those parts from which there are letters or requests for these cars," Oleg Hetman explained.

Oleg Nazarenko, CEO of the All -Ukrainian Association of Automobile Importers and Dealers, believes that there should be a certain system in transmitting cars for the military. He personally participated in the organization of transmission of about nine thousand cars from auto importers and dealers for military units.

When he was called unknown people asking for a car, he asked for those to contact the Head of the Armed Forces Logistics Department, that he said Nazarenko about the needs of the car. He told focus that the volunteer must first take the first letter from the brigade commander, which he did not deny that he would be brought a car, and the second letter to the State Customs Service with a request to promote the import of a car that will be transferred to a specific military unit.

"And you then take, bring this car and give it to someone else. What do you think it is a violation of the law? Is it decent? The commeser hopes for this car, does not ask for the head of the Armed Forces Department of the Armed Forces another, because he knows that he will be brought," - - - - He explained. He is convinced that such actions also harm the defense capability, because the customs gathers information on which military units were imported.

This information reaches the General Staff, where they are convinced that a specific unit will receive conditionally four cars, and therefore it is not considered to be replenished. In addition, he has doubts about the person who brought the car allegedly for the Armed Forces, but used transport for several years.

So volunteers are those people who bring assistance to the Armed Forces, and not those who in 2022, under the guise of the army, brought cars without taxes, used for several years, and now decided to give. It is suggested that these people do not just pass cars now, but they came to law enforcement officers and found out that cars were imported without taxes for the army, but a civilian person rides.
