The Supreme Court did not allow dismissal from the Armed Forces if mobilized illegally: what are the grounds

To spread: mobilization has an irreversible process and a citizen cannot be released from the army due to non -medical commission, the Supreme Court has decided. The Cassation Administrative Court of the Supreme Court considered the case of a man who was mobilized to the ranks of the Armed Forces of Ukraine without passing the Military Medical Commission. The judges confirmed that there were indeed violations of the territorial assembly center, but did not allow the dismissal of the serviceman.

The details of the decision are explained, which appeared on the portal of the Supreme Court on March 17. The portal was told about the Resolution in Case No. 160/2592/23, which was adopted on February 5, 2025. It is a lawsuit in which the military unit asked to cancel the decision to release a man mobilized with a violation from the army. The military explained that it is impossible to be released simply on the basis of a violation of the CCC.

Let the citizen first pass the medical commission and, if unusable, he will be released on this basis. Two courts of previous instance agreed that the Ukrainian was mobilized without a medical commission, it is a violation by the CCC and therefore the military unit should be released, told on the portal of the APU. But the Supreme Court disagreed with such a decision, it was stated in the document published in the register of pre -trial decisions.

For example, on January 17, a citizen who was booked by a supermarket network was canceled in Lviv. The court found that at the time of the military enlistment office a citizen had already had a deferral from mobilization, but the Tercenter was neglected by this information.
