To spread: in the path of the struggle of Germany with Russian drones appeared an unexpected obstacle - the Nazi heritage. The country's army cannot knock down foreign UAVs even in its own airspace. The German constitution, adopted after the Second World War, directly forbids the army to play a key role in the country's internal security. The document was developed in this way, because the Nazis and their associates have historically abused Germany's military force to combat left political forces.

This is stated in Politico, published on October 10. "But today, against the background of seemingly escalation of the Kremlin campaign for the test of Europe through numerous invasions of drones, these constitutional protection measures have an unpredictable side effect: they limit the ability of Germany to defend themselves from the provocations of Moscow," - said in the publication.

Because of the Germans imposed by the Germans themselves, measures from repeating the mistakes of the past, their military simply cannot knock down drones in the domestic airspace. The post -war constitutional provisions make the country more vulnerable in the conditions of aggression of the Russian Federation.

"We need to amend the laws so that the only ones who can engage in it, namely the Bundesver, have also received appropriate powers," said the head of the Defense Committee in the Bundestasis Thomas Ryovekamp. Theoretically, Germany's armed forces can take up weapons in the event of a large -scale invasion. However, as legal experts explained, the invasion of drones is not considered such serious attacks.

According to the legislation, the Bundeswehr is allowed to knock UAVs only over military bases. There is no evidence that drones that invaded the airspace of Germany were dangerous. According to the German authorities, the Russian Federation uses its UAVs for espionage. Last year, the drones recorded on the objects of the weapon manufacturer Rheinmetall and the chemical concern BASF. Police have a legal right to knock them down, but law enforcement officers do not have technical capabilities.

"The Federal Police, as well as almost all the state police forces, have no opportunity to protect against drones," Ryavecmp admitted. The military has more opportunities but are limited to act. The publication conveyed that such a situation "puts German leaders in a difficult position", because they seek to respond to the provocations of the Kremlin.

Currently, the Bundeswehr is only allowed to provide "administrative assistance" - to assist with UAV identification and to transfer data on request. German Interior Minister Alexander Dobrindt plans to create a unit for counteracting drones within the Federal Police and establish the National Center for Combating Dron. This will allow law enforcement, intelligence and army to combine resources.

He also wants to move the law on the possibility of killing military drones in the German airspace if there is a threat to people's lives. However, it is unclear whether it will not contradict the Constitution. The German politician Marie-Agnes Strak-Zimmermann has warned that if the military provides more for "administrative assistance", it threatens the Constitutional Court. The media stressed that Germany is at risk of remaining relatively defenseless in the near future.

The only long -term solution is to amend the Constitution. "The world has changed, and there is no difference between internal and external security. Looking into the future, we must adapt our constitutional provisions to reality," - summed up Ryovekamp.
