The Ukrainian court acquitted the occupier suspected of looting: there is insufficient evidence

Share: The Russian serviceman, who was suspected of robbing the house of a resident of the village of Blystavitsa, Buchansky district, Kyiv region, was found innocent. The corresponding decision was made by the Borodyansky district court, citing the fact that there is insufficient evidence that it was the suspect who stole the women's things and sent them home to Rubtsovsk, Arkhangelsk region, according to court documents.

According to the materials, the occupier, who is a member of the Ros Guards, was with his unit in the Buchan district from February 24 to March 27, 2022. He made his way to the house of a local woman, from where he took an angle grinder, a screwdriver, an electric grinder, a hard drive, a video camera from a computer, as well as men's clothes and shoes. The hostess left the village at the time of the robbery and did not see what was happening.

At the end of March, during the retreat of the Russian Armed Forces, he took all the stolen things to Mozyr (Belarus), from where he sent a parcel weighing 24 kg to his home in Rubtsovsk. When the case got underway, the Russian was given a lawyer, and he himself was declared an international wanted man.

During the hearings, the court examined the footage published by one of the Ukrainian publics, taken at the Mozyry post office, where the occupiers are sending home parcels with looted goods in Ukraine. Also, the consignment notes were published on the network, one of which contained the suspect's name.

The victim's neighbors confirmed her words about the robbery, and one of them even found a plate from a Russian armored personnel carrier in the garden, which indicated the number of the military unit and the name of the person responsible for the equipment.

In the end, the court came to the conclusion that the Russian Guardsman was indeed in the Buchansk district during the specified period and that he later sent a parcel from Belarus to Russia, and also did not question the testimony of the victim and witnesses. Despite this, the judge decided that the prosecution did not provide "sufficient, proper and admissible evidence that the theft of property from the victim's house was committed by the accused.

The accusation cannot be based on evidence obtained illegally, as well as on assumptions. All doubts about the proven guilt of a person are interpreted in his favor. Based on this, the Ukrainian justice found the Russian soldier innocent and decided to acquit him due to the lack of evidence that he committed this criminal offense.
