According to the charter, this body can only make recommendations to states.
The second reason is that the idea may not have enough votes. According to the voting in the General Assembly, when it comes to active measures, such as the exclusion of the Russian Federation from the Council on Human Rights or the creation of a register of losses, the number of votes in support falls. "The worst option would be to initiate a fallen resolution or weak support. Because it is important for Ukraine to maintain the support of the international community," Van Skaak explained.
According to the ambassador, there are states that are cautious about the creation of a new great court. In addition, it is unclear who will finance the expensive lawsuit. At the same time, Van Skaak emphasized that the internationalized tribunal can be created quickly. In this case, it will be possible to apply to the General Assembly to approve a resolution that would encourage states to find ways to cooperate with this institute.
