It was reported that the ranks of mercenaries were opened for persons who did not participate in the war in Ukraine, and people without army experience, as well as citizens with HIV and hepatitis. It was noted that there would be no persons who have passed after the military rebellion of Prigogine in the Ministry of Defense of the Russian Federation. On October 17, the State Duma adopted a bill, which enables Rosgvardia to create "volunteer formation".

The Russian media suggested that the emergence of "volunteer formations" of Rosgvardia would allow them to become mercenaries. However, one of the authors of the bill, deputy Alexander Hinstein, denied that changes in the legislation are aimed at transferring the former units of PEC "Wagner" to Rosgvardia.
