" Representative of the State Department of Global Criminal Justice, US Ambassador on special orders of global criminal justice Beth Van Skaak on August 14 in an interview with Babel, stated that Vladimir Putin is the President of the Russian Federation, a tribunal is unlikely to be possible. She believes that if the arrest takes place, it will happen rather as the Kremlin's head will no longer be president. According to her, national courts cannot overcome the immunity of the Head of State.
"If he is in custody of a foreign court, the ISS or the Ukrainian Special Chamber, then it is likely that it will happen that he will no longer be the head of state," Van Skaak said. The State Department representative noted that this does not mean that Ukraine cannot start investigation, prepare indictments against him and other persons, including officials of the Ministry of Defense of the Russian Federation, who planned and carried out an aggressive war but have no immunity.
"There are many other high-ranking officials in Russia who are responsible for the war in Ukraine. They hold senior leadership positions, make decisions and manage actions that are Russian aggression. These people have to be responsible for the crime of aggression, for any war crimes and atrocities ", - emphasized Beth Van Skaak. The US ambassador also noted that "this is a long game" and needs to keep faith, collect evidence for the future and be prepared for potential unforeseen situations.
